Terms and Conditions (Consumer Services & Products)

Welcome to Liverpool Visuals. These Terms and Conditions apply to individuals making purchases for personal use (as "Consumers"), including for our photography/videography services (such as weddings and family events) and for products from our online store.

If you are planning to use our services for a commercial use (eg, listing a property online, selling a product, including on social media) or if you are representing a company, please see these terms here.

By using our services or purchasing from our store, you agree to be bound by these Terms and Conditions. Please read them carefully.
1. Company Information
Liverpool Visuals is a UK-based provider of professional aerial photography, videography, and creative media. We also sell printed media and merchandise through third-party fulfilment partners, including Printful and Loxley Colour.
2. Consumer Services (Weddings, Family Events, etc.)
2.1. Booking Fee (Retainer)
To secure your date for a service (e.g., a wedding or retail photoshoot), we require a non-refundable Booking Fee. This fee is typically 30% of the total service cost, unless otherwise agreed.

This Booking Fee is non-refundable because it secures the specific date and time of our services exclusively for you, preventing us from taking any other bookings for that date. It also covers the administrative and planning work already undertaken. This fee represents a genuine pre-estimate of the loss we incur in the event of a cancellation.
2.2. Payment

For Weddings: The final, outstanding balance of your service fee is due 14 days before the event date.

For other Retail Shoots: The final balance is due upon completion of the work and prior to the release of the final digital files.

We will not attend an event or release any photographs or videos until the balance is paid in full.
2.3. Cancellation by You (The Client)
All cancellations must be made in writing (e.g., by email). The following terms apply:

Cancellation (at any time): The non-refundable Booking Fee (as per clause 2.1) will be forfeited.

Cancellation of a Wedding (within 60 days of the event): 50% of the total service fee becomes due.

Cancellation of a Wedding (within 30 days of the event): 100% of the total service fee becomes due. This reflects the high probability that we will be unable to re-book the date at such short notice.

Cancellation of a Retail Shoot (within 72 hours of the shoot): 50% of the total service fee becomes due.

2.4. Cancellation by Us (Liverpool Visuals)
In the highly unlikely event that we have to cancel (due to illness, force majeure, or any other unforeseen circumstance), we will make every effort to find a replacement photographer/videographer. If we are unable to, or if you prefer to cancel, we will issue a full refund of all monies paid, including the non-refundable Booking Fee.
2.5. Postponement & Re-booking
In the event of a postponement by the Client, the non-refundable Booking Fee will be transferred to a new date, subject to our availability. A new date must be agreed upon within 30 days of the original postponement. If a new date cannot be agreed upon, this will be treated as a cancellation by the Client.
2.6. Service Standards
We will perform all services with "reasonable care and skill" as required by the Consumer Rights Act 2015.
However, we are not responsible for poor outcomes resulting from factors beyond our reasonable control. This includes, but is not limited to:

Poor weather conditions affecting light or the ability to fly a drone.

Restrictions imposed by the venue, registrar, or other external officials. This includes, but is not limited to, airspace restrictions from airports (due to potential conflict with other aircraft), or restrictions imposed by the police (in the interest of public safety) or emergency services (for operational reasons). This may occur mid-shoot in the event of the sudden, unexpected approach of an aircraft used for firefighting, search and rescue, or crime detection. This also includes restrictions from landowners, councils, and animal welfare or conservation organisations (e.g., National Trust, Forestry England, RSPB, RSPCA, Wetland and Wildfowl Trust) related to public right of way, safeguarding, nesting birds, or protected conservation areas.

Inadequate lighting or sound conditions at the venue.

Interference from guests or other suppliers.

3. Product Sales (Online Store & Client Galleries)
3.1. Fulfilment Partners
We use two primary fulfilment partners for our products:

Printful: Our 'Print Shop' (accessible from our main website) sells merchandise such as framed pictures, clothing, mugs, t-shirts, and tote bags. These items are produced and fulfilled on demand by Printful.

Loxley Colour: Prints ordered directly from a client's private gallery (for photos delivered after a shoot) are professionally fulfilled by our lab partner, Loxley Colour.
3.2. Order Fulfilment & Shipping
All orders are printed and shipped directly by our fulfilment partners (Printful or Loxley Colour) from their facilities. Estimated delivery times are provided at checkout. These are estimates only and not guarantees. Liverpool Visuals is not responsible for delivery delays caused by the courier, customs, or other external factors.
3.3. Returns and Refunds (Products)
As all our products are "made to order" (bespoke), returns are only accepted for damaged, defective, or incorrectly fulfilled items.

If your item arrives damaged or incorrect, please contact us within 7 days of delivery with photographs and a description of the issue.​

Refunds or replacements are issued at our discretion in accordance with our partners' return policies.
4. Your Consumer Rights (14-Day Cooling-Off Period)
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have a 14-day "cooling-off" period for most goods and services bought online. Please note:

For Services (e.g., Weddings): This 14-day right to cancel does not apply to our services. The regulations provide a specific exemption for contracts related to "catering or leisure activities for specific dates". A wedding or event booking, which reserves a specific, non-transferable date, falls into this category.

For Products: The 14-day right to cancel does not apply to "made to order" or "personalised" goods, such as the items from our Printful store and Loxley Colour gallery.
5. Intellectual Property & Personal Use License

All content, images, videos, and branding under Liverpool Visuals are the exclusive property of Liverpool Visuals. We retain the copyright at all times.

Upon full payment, the Client is granted a non-exclusive, non-transferable, perpetual licence for PERSONAL, NON-COMMERCIAL USE ONLY.

This means you can print images, share them on your personal social media, and give them to friends and family.

This means you cannot sell the images, alter them (e.g., apply filters), use them for any commercial purpose, or submit them to competitions without our explicit written permission.
6. Data Protection & Your Privacy (GDPR)
We take your privacy seriously and act as a Data Controller in compliance with UK GDPR. Please see our full Privacy Policy for details.

Promotional Use: We respect your privacy. We will not use any images or videos from your private event (such as a wedding or family party) for our own marketing, portfolio, or social media unless we have your separate, explicit, opt-in written consent. You are never required to provide this consent as a condition of our service.
7. Limitation of Liability

In the extremely unlikely event of a total failure (such as equipment failure, data loss, or non-attendance at your event), the total liability of Liverpool Visuals shall be limited to a full refund of all monies paid by the Client for that specific service.

We are not liable for failure to perform due to events beyond our reasonable control, including but not limited to acts of God, extreme weather conditions, equipment failure, illness, or government restrictions (Force Majeure).
8. Governing Law
These Terms and Conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England.
9. Changes to Terms
We reserve the right to update these Terms and Conditions at any time. The latest version will always be available on our website.
