Aerial Operations - Terms & Conditions

1. Introduction

These Terms and Conditions apply to all aerial photography and videography services provided by Liverpool Visuals Limited (“we”, “us”, or “our”) to the client (“you” or “the client”). By engaging our services, you agree to be bound by these terms.

2. Services

We provide aerial photography and videography services using Civil Aviation Authority (CAA) registered drones operated by qualified pilots. All flights are conducted in compliance with UK drone legislation.

Services include, but are not limited to:

• Aerial photos and video capture
• Site surveys and inspections
• Post-production editing (where applicable)
• Delivery of digital files via secure transfer

3. Booking & Deposits

A 20% non-refundable deposit is required to confirm a booking for new clients.

The remaining balance is payable on or before the delivery of final content.

Work will not commence until the deposit has been received.

Repeat clients may be offered payment on completion, subject to agreement.

4. Payment Terms

Invoices must be paid within 14 days of the invoice date, unless otherwise agreed.

Payment methods accepted: Bank Transfer, Direct Debit, or approved payment gateway.

Late payments may incur interest at 8% above the Bank of England base rate, plus a fixed late fee in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

5. Cancellations & Postponements

Cancellations made with more than 72 hours’ notice will not incur further charges, but the 20% deposit is non-refundable.

Cancellations made within 72 hours of the agreed flight date may be subject to additional charges to cover preparatory costs.

Postponements due to unsafe weather or regulatory issues (e.g., temporary airspace restrictions) will be rescheduled at no extra cost.

6. Weather & Flight Conditions

All drone operations are weather-dependent. We reserve the right to delay, reschedule or cancel a flight due to:

1. High winds
2. Heavy rain or low visibility
3. Nearby hazards or airspace restrictions
4. In such cases, we will work with you to rearrange the service at the earliest opportunity; if you elect not to continue or we cancel a flight, we will refund any deposit paid if an alternative date is not suitable.

7. Licensing & Usage

• Upon full payment, you are granted a royalty-free, non-exclusive licence to use the delivered media for your stated purposes.
• Liverpool Visuals Limited retains copyright and moral rights to all original aerial content.
• You may not resell or sublicense the content without prior written consent.

8. Client Responsibilities

You are responsible for:

• Obtaining necessary permissions for flights over private property
• Providing accurate location details and usage requirements
• Ensuring that our team has safe and legal access to the shoot location

If you are unsure or need assistance with the above points, we can carry out a pre-flight site survey at an additional cost. This is highly recommended if the flight location is near or will likely overfly any of the following:

• within 1.5 miles of an airport, airfield, heliport or other location to which other aircraft take off or land such as model aircraft & microlight airfields.
• Any property belonging to the Ministry of Defence
• Any Nuclear power station or facility
• Prisons, Young Offenders institutions & Secure Hospitals
• Schools & Nurseries
• Any land or property owned or operated by The National Trust
• Overflying of crowds of 100 people or more, such as near concerts, stadiums & Arenas

We provisionally vet all flight locations as part of the quotation process. If the proposed location and date conflict with a flight restriction, we may refuse the work or suggest an alternative date. These are often added with little notice, and therefore, it is likely that a restriction may be added after a deposit is taken. If this is the case, and you do not want to continue, we will refund your deposit.

In the event the client refuses a pre-flight site survey, we will not refund a deposit if we are unable to fly due to a restriction or lack of permissions, inaccurate location or lack of access, as this will fall on the client to check and not Liverpool Visuals Limited. If we attend the site to carry out a drone flight, we will charge for any time on-site and any costs incurred if the client has not carried out their due diligence and/or refused our assistance in assessing the suitability of a flight location.

9. Liability

We carry Public Liability Insurance for aerial operations.

We are not liable for any delays or failure to deliver content due to factors beyond our control (e.g., weather, regulatory action).

Our liability for any claim arising from our services is limited to the total amount paid by you for the specific engagement.

10. Data Delivery & Retention

Final content will be delivered via secure download link or agreed method.

Raw footage or unedited files will only be provided upon prior agreement and may incur an additional fee.

We retain backup copies of your content for up to 6 months, unless otherwise agreed.

11. Governing Law

These Terms and Conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
